Job Summary

The in-house Corporate Counsel will be responsible for the following:

 

Areas of Responsibility:

1.    Prepare, review and revise employee-related documents (e.g., employee agreements and policies) - US employee documents (some examples below)

  • Offer Letters
  • @home documents (e.g., equipment returns)
  • Background Check Documents (Consent and Disclosure forms)
  • Employee Applications

2.    Review policies to ensure compliance regulatory compliance with US law (e.g., FMLA, ADA, OSHA ERISA).  Examples of policies.

  • US Handbook
  • Social media
  • FCPA
  • (FLSA) Wage and Hour Policies

3.    Coordinate and assist with nearshore and offshore employee-related documents

  • Work with respective local in-house or external counsel 
  • Review global policies as needed.

4.    Prepare training modules on a range of employment-related topics (e.g., fraud, harassment)

  • Positive Employee Relations Training (a.k.a. union avoidance)
  • Perform legal/compliance training as may be applicable.
  • Workplace Safety Training

5.    Employment Claims/Litigation/Issues

  • Manage US employment-related claims (e.g., EEOC charges, DOL Wage Claims) and litigation including the management of outside counsel
  • Handle discovery for litigation matters including collecting and reviewing documents, provide guidance to outside counsel and engaging in strategy discussions with outside counsel
  • Tracking and coordination of all global claims in coordination with offshore and nearshore in-house or external local counsel
  • Monitor and assist with handling of “speak-up” complaints.

6.    Employment Law (Person Office) Advisor to Manage Risk Across the Business
        a) Provide accurate and timely guidance on a wide range of employment-related areas to manage risk across the business, including, but not limited to:

  • leaves of absence/accommodations
  • reorganizations (RIFs)
  • employee investigations
  • OSHA investigations
  • Workers Compensation Claims.
  • hiring/discipline/terminations/performance management
  • wage and hour compliance (time-keeping audits)
  • compensation and benefits 

       b) Review bonus plans, compensation guidelines, summary plan descriptions and separation agreements
       c) Stay on top of constantly changing federal, state and local labor and employment laws throughout the US
       d) Conduct US based employee investigations (in coordination with other departments)
       e) Coordinate and manage employment related projects, including internal process reviews, new policy roll-out and implementation, and training programs.

7.    Assist with M&A Employee/Labor Matters 

  • Assist with HR Due diligence 
  • Assist with Employee/HR Integration

Proactive Counselor: Anticipates changes in law, enforcement, and/or business objectives and adapts approach as necessary to manage risks effectively and mitigate issues before they arise.

Influencing Skills: Build strong relationships with business partners to artfully and skillfully influence and gain support to drive desired outcomes. Represent Qualfon to customers, trade associations or government agencies; and resolve legal issues using negotiation skills and legal expertise.

 

Minimum Experience: 

  • Candidates must possess a law degree and be currently licensed to practice.
  • Must have at least 3 years’ experience working with US employment/labor laws.
  • Minimum of 5 years of management-side labor and employment law counseling.
  • In-house experience preferred.

Full-time employees are eligible to receive paid time off (PTO) benefits based on the Company’s current paid time off policies and in accordance with applicable state law. All benefits are subject to any plan changes at the Company’s sole discretion.

 

Compensation: this position will be paid on a salaried basis with a pay range between $120,000 - $145,000 annually depending on prior experience. This base pay is subject to all applicable statutory deductions and authorized withholdings as required by law. This base pay is also subject to any authorized deductions to contribute toward the employee’s portion of benefits premiums and/or 401(k) contributions.
